Terms of Service

1. Acceptance of Terms

By accessing or using NightFlight Pro (“the App,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the App.

If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of the Service

NightFlight Pro is a software application that retrieves and displays data from third-party services, including endpoint security tools, through authorized application programming interfaces (“APIs”).

The App functions solely as a temporary data visualization and viewing tool. Data is displayed in real time and is not stored, persisted, cached, or retained by the App once the user exits, logs out, or closes the App.

3. Third-Party Services and APIs

The App relies on services and APIs provided by third parties (“Third-Party Services”). We do not own, operate, manage, or control these Third-Party Services.

You acknowledge and agree that:

All data displayed by the App originates from Third-Party Services
The accuracy, completeness, availability, and timeliness of such data are the responsibility of the Third-Party Services
Your use of the App must comply with all applicable third-party terms, licenses, and policies
We are not responsible for outages, API changes, data inaccuracies, interruptions, or failures caused by Third-Party Services

4. Data Handling

Data is retrieved solely for on-screen display
No data is permanently stored, logged, cached, or retained by the App
All data is discarded when the user session ends

5. Subscription and Payment Terms

Certain features of the App require a paid subscription.

By purchasing a subscription, you acknowledge and agree that:

Payment grants access to the App’s functionality only
Subscription fees do not guarantee data accuracy, availability, security outcomes, or operational results
Paid access does not expand or modify our responsibilities or liabilities under these Terms
We do not guarantee uninterrupted service, error-free operation, or compatibility with any Third-Party Service

All fees are non-refundable except where required by applicable law.

6. Security Disclaimer

The App displays data sourced from endpoint security tools for informational and visibility purposes only.

You acknowledge and agree that:

The App does not provide security monitoring, threat detection, incident response, or remediation services
The App should not be relied upon as a sole or authoritative source for security decisions
We do not guarantee that displayed data reflects real-time threats, vulnerabilities, or system conditions
Use of the App does not replace professional security analysis, monitoring solutions, or security best practices

You assume full responsibility for decisions made based on information displayed in the App.

7. User Responsibilities

You agree to:

Use the App only for lawful purposes
Ensure you have proper authorization to access and view any data retrieved through Third-Party Services
Maintain the confidentiality and security of any credentials, API keys, or access tokens
Not reverse engineer, disrupt, interfere with, or misuse the App or its systems

8. No Warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
ACCURACY, RELIABILITY, OR COMPLETENESS OF DATA
AVAILABILITY, UPTIME, OR ERROR-FREE OPERATION

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIGHTFLIGHT PRO, ITS OWNERS, DEVELOPERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS.

THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE APP IS USED UNDER A FREE OR PAID SUBSCRIPTION.

10. Indemnification

You agree to defend, indemnify, and hold harmless NightFlight Pro, its owners, developers, officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use or misuse of the App
Your violation of these Terms
Your violation of any applicable law or regulation
Your access to or use of Third-Party Services or data
Any claim that you lacked proper authorization to access or display data through the App

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

13. Mandatory Arbitration and Waiver of Class Actions

PLEASE READ THIS SECTION CAREFULLY.

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved by binding arbitration, administered under the Federal Arbitration Act and conducted in the State of Texas.

You agree that:

Arbitration will be conducted on an individual basis
You waive any right to participate in a class action, collective action, or representative proceeding
The arbitrator shall have exclusive authority to resolve disputes relating to the interpretation or enforceability of this arbitration agreement

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

14. Venue for Injunctive Relief

Notwithstanding the arbitration requirement, we may seek injunctive or equitable relief in state or federal courts located in Texas to prevent unauthorized use, misuse, or infringement of our rights.

15. Changes to These Terms

We may modify these Terms at any time. Continued use of the App following such changes constitutes acceptance of the revised Terms.
